Indigenous peoples have, guaranteed by the 1988 Federal Constitution, the original right over the lands they inhabit. However, this right is in constant dispute, since certain sectors of society, dissatisfied with articles 231 and 232 of the Federal Constitution of 1988, obtain the support of politicians, who present a variety of amendments and bills with the aim of to invade the territory of the native peoples of Brazil. Based on E. P. Thompson’s “rule of the law” thesis, this article will discuss the temporal framework thesis and indigenous protagonism in the face of attempts to set back their guaranteed rights.
